What I suspect was happening was this: they saw a question without a line reference, and if they didnt remember the answer, their immediate reaction was to panic and (subconsciously) assume  that the answer was going to be buried somewhere in the middle of the passage somewhere very difficult to find. Basically, they were so used to assuming that things would be hard that it never occurred to them that they might actually be easy! Had they simply scanned for the key word/phrase starting in the introduction and skimmed chronologically, they would have found the answer almost immediately. Inevitably, when I had them re-work through the questions that way, they had no problem answering them correctly. So if you find yourself confronted with a straightforward, factual reading comprehension without a line reference and have absolutely no recollection of where the answer is located, dont just jump to somewhere in the middle of the passage and start looking around. Instead, figure out what word or phrase youre looking for, and start scanning quickly for it from the very first sentence, pulling your finger down the page as you scan to focus your eye and prevent you from overlooking key information. However, after some time the daughter got married and she left her law studies incomplete. The mother claimed that since the daughter failed to complete her legal studies, hence the house possession should no longer be with the daughter. The court in the case presented opined that the nature of the agreement between the parties was of domestic nature and hence governed by the presumption that the parties do not intent to bind each other in legal relations since nothing contrary has been brought forward explicitly which indicates the opposite to be true (Pendleton Vickery, 2005). Application The given situation needs to be analysed in the wake of the decision taken in the Jones v Padavatton (1969) 1 WLR 328case. As per the relevant case facts, Richard and his father have entered into an agreement whereby Richard is required to mow the yards (both front and back) present on the property owned by the family and ensure that the tidy state of the gardens. Considering that the property size was huge, it would take atleast half a day every week to discharge his obligations in return of which, he would receive a compensation of $ 200 weekly. This work was previously being performed by the garden contractor who used to charge $ 350 for the same amount of work. The father later could not afford making the promised weekly payment ordered that Richard should give his services for free as it the responsibility of the family members for keeping property well maintained and tidy. Besides, he also indicated that by ensuring Richards stay in the house, he was able to gain access to boar ding and lodging absolutely free of cost. There is no evidence in the situation to deny the presumption that with regards to the promise, there was lack of intention on the end of the parties so as to enter into legal relations considering the fact that it is a domestic agreement. NightCrawler A Real Monster in A Fictional world NightCrawler is a film Written and Directed by Dan Gilroy and stars the incredibly popular Jake Gyllenhaal. The Movie follows Lou Bloom, a single adult trying to find a job that he can develop into his career. From the moment the film starts we can see that Lou is an odd protagonist. He is clearly looking for something, a fulfillment to his life. This is even shown in his first line of the script when a cop approaches and asks him what he is doing, he simply states, â€Å"I’m lost.†It is not until Lou discoveres the world of Tv journalism that he feels he truly might have found a place for himself. Or at least, a start. From the first moment we see Lou enter the world of Journalism it is clear that he actually found something he enjoys doing. And he is good at it. But what makes Lou such a unique and intriguing character is that he is a sociopath. Lou blends his sociopathic traits very well with his politeness to create a very eerie and intimidating personality. However, he uses this to his advantage on multiple occasions. His lack of empathy and drive to succeed really shows the audience how hard of a worker he really is. Which ends up landing him a job working as a freelancer for a local news company. We see very early on that Lou will do whatever it takes to maintain this. Even going as far as moving dead bodies at a car accident to get a better shot. One of Jeffery Cohens theories states that, â€Å"The monster Dwells at the Gate of Difference.†(7) This theory applies to Lou in a sense that throughout the whole film, Lou is trying to become an active member of society. The second scene of the movie shows him approaching a construction worker attempting to get a job. We see right away that he is looking for a fulfillment to his life. He does not want to be different from everyone else, he just wants to fit in. But Lou’s sociopathic tendencies are keeping him balancing on the border of having that normal life, and losing it completely. The entire film is Louis doing what he thinks is right for him to advance in his newly founded career. He has no problem severely injuring or even murdering others as it is shown later in the film. His Motivation for succeeding as a TV Camera reporter motivates him to do completely unethical things. Cohens sixth theory, â€Å"Fear of the Monster Is Really a Kind of Desire†(Cohen 16) really shows the reason this character was created. That is why we are quick to sympathize with the character throughout the whole film. We as an audience understand his actions are not morally correct, but we understand why he is doing them. He wants to fit in, have a normal job and be an active member of society. And in return, this creates what is known as an Antihero. A character who lacks morality and, although not in this case, courage. The antiheroes perform actions that are usually indeed morally right but for their own self interest or profit. Lou’s sociopathic nature allows him to excel at his job which only shows the true problem with this, that society rewards the creation of these monsters. The director himself confirms this as a key factor in the writing process of the film. Not only is it bringing to light the true horrific nature of some people and their dedication to getting the job done, but it also shows why it is morally and ethically wrong. But what defines a sociopath? Is it the way they were raised or how they were raised? It is a very internal process. In the case of males, their hormones seem to stimulate the growth of the amygdala, a key area that modulates anger, hate, and aggression (Mohl 4). Louis manages to show all of these traits throughout the entire film. He has a clear sign of anger when he lets his boss down. He also clearly hates his rival and shows aggression to him in his calm toned manner which is even more frightening. Lou is a hard worker and that is made very clear from the beginning of the film. He is determined to be the best no matter what the cost is. When he arrives late to an accident, his rival is there bragging about the big scoop he got. Which leaves Lou returning to his boss with nothing. Which results in her yelling at him and overall, disappointing a respected figure of his. This becomes one of the major turning points for Louis in with his Sociopathic tendencies. Which end up causing Lou to cut the breaks of his rivals van which leads him to an almost near death accident. And of course, Lou is front and center to capture it all to please his boss. He did not decide whether what he was doing was morally right or not. He simply wanted to be the best in his field. With all of the negative and horrific things the character has done so far we still see him as the protagonist. But why? Well it is because of one easy word, empathy. â€Å"The audience’s emotional involvement is held by the glue of empathy†(McKee 141). We use empathy towards Louis and his actions because even though we understand it is not morally right we still want him to succeed because we feel bad for this isolated individual. Even louis uses empathy on himself to justify his actions. He believes that if he just does this one kinda bad thing his life would be so much better from it. He knows that he will get away with it because he is intelligent and has a fantastic alibi to help him get away with these horrendous actions. Jake Gyllenhaals portrayal of Lou is one of the reasons this movie was so successful. The ability to have him be polite and intimidating with a dash of insane really develops a great on screen adaptation of what someone like this would be like. Determined to get the job done no matter what the cost was. Not thinking about whether what you are doing is right or wrong but if it is good enough. And for the NightCrawler, it was. Another difference between the Socrates of the cloud and Socrates of platonic ideas besides being a teacher is that in the clouds he is not against nature but following it. Aristophanes says that Socrates emerged in a balloon basket hanging mid-air. He was thus walking in the air to speculate about the sun. He discovered that he was indeed the wisest since those who consider themselves wise did not know what to be wise means but at least for him he did not pretend to know and the beginning of wisdom is accepting that we do not know and surely if the gods decided he was wise then he must be wise. A cohort study is also known as longitudinal study in which the cohort group is studied with respect to a general population (Catlin and Maupin, 2004). I was exposed to a similar situation when I attended Christian university, for a period of 22 months and went through 11 classes each seven weeks long. I was studying with a cohort group with similar people. This group was similar in terms of age group, knowledge level, education inheriting from the same university. It was natural that the way of understanding the knowledge and interpreting them, was very much similar, as taught by our lecturers. I have had varying experiences during my study tenure in the cohort group. Few days after the classes started in full swing, we started losing our students. Few students dropped out and few were called off by their parents because of personal reasons. Even though most o f the participants were of similar age, we had an old lady. The study materials we had been very helpful and lecturers helped us during the research. There were few misunderstandings and quarrels too. Few of the participants of the cohort were not in line with the techniques used by the rest of the cohort during the tenure. But these issues were resolved at the end with proper understanding and some compromises from both the groups. Being in a cohort with the same group of students is quite an experience. The norming and forming is constant. It is also good to know that every time we have to present it is in front of people you know and acquainted with. It helps to boost experience and better results are generated. Reflection The basic concept which I understood is that group or team dynamics is a system of psychological and behavioral process which occurs within a social group. It can also be termed as intra group dynamics which means actions and their subsequent reactions and cons equences occurring within a group. From the classes which I attended on this particular topic, I was able to understand that group dynamics is done with the objective of understanding behaviors such as decision making, creating and implementing new techniques and ideas, making new ideas viable in the society and making them useful for the current as well as future generation. Expect the quantity and characteristics of the manpower in demand for future needs based on projecting employer past trends. According to Mahapatro, et al. 2010, â€Å"in the Indian context, it has been observed that over 30 percent of the manpower do not have the basic minimum qualification. They have reached these levels through on-the-job training and such other informal training in the requisite skills.†The second limitation: This method confirms that there are no replacements for the required skilled manpower; however we cannot expect to find in one country all jobs requiring a specific skill to be executed by manpower having the same category of education. According to Mahapatro, et al. 2010, â€Å"the educated manpower of different types are used in fixed proportions and that there no substitutions possibilities among the various categories of educated manpower†. The future is uncertain, technological and economical factors constantly changing affect the patterns of demands predicted in an earlier stage, since estimated skilled or unskilled labour force is derived from the patterns of services or goods in demand, this approach is relatively unreliable for future for long turn estimates and can produce large errors. According to Mahapatro, et al. 2010, â€Å"Any error in judgment, in this regard, will seriously affect manpower balances at a later date resulting in either excess supply or excess demand†. Flexibility For example the Audit Commission, they have developed different type of employment to meet their business needs. â€Å"†These different contracts help the Audit Commission to cope with all of its changing needs. They also help it to be flexible.†(The Times 100, 2013) The Audit Commission is constantly faced with peaks and troughs in the workload that cannot be met simply by having its employees on full-time contracts. There are situations where they need either more staff or fewer staff. By increasing or reducing staff in these situations the Audit Commission has developed numerical flexibility. (The Times 100, 2013) As we know the organisation had some success stories and some unstable situation, HR planning at this phase after winning a new contract is extremely crucial. We can learn from the Audit Commission and apply flexibility to be able to meet future business needs without raising employment cost and by avoiding downsizing. I can suggest developing and applying flexible working patterns by introducing different type of employment contracts. As for a construction company that have just signed a new hotel construction project that will end in 5 years, they cannot afford to hire employees on permanent contracts for the new project, as they will have surplus after the hotel is build. In this situation by applying the new working patterns the manufacturing company can meet the new contract needs and ensure that we will not have a manpower surplus after the project is done, it is always easy to increases the number of the workforce but not simple to reduce it. Since the company have liabilities toward their workforce. The cost is extremely high to offer all its employees benefits, health insurance, schooling, bonuses and end of service indemnities. Question 2: As we have discussed before temporary workers play a significant role in current fast pace evolving industries, no matter how skilled or unskilled they are, a certain amount of training is required to make sure they can perform well the assigned tasks. We have to plan the training process and identify the gaps. According to Gomez-Mejia et al, 2012 â€Å"The trainng process consists of three phases: (1) needs assessment, (2) development and conduct of training, and (3) evaluation.†2.1 Assessment Needs: The type of training should be linked to the organisation goals, in our organisation situation the company needs to meet the new project production needs on time efficiently without compromising the quality. By hiring the new temporary workforce, the company is not looking to develop them or invest in them, as they are only hired to assure the production for a certain period. However we need their contribution to achieve company goals and meet business demand, the required training should enable them to acquire the skills and the knowledge, by identifying a certain type of training that will ensure they are prepared to do the assigned tasks and have the complete knowledge of the company procedures and safety related issue. 2.2 Development and conduct of training We can refer to Aldi’s company case study that was experiencing a rapid expansion and needed to recruit more than 4,000 employees. It is not so easy to involve a large number of employees and engage them to the company objectives, we can examine below how Aldi’s planned to train the new workforce and make them committed to their new roles. They have chosen to provide the on-the-job-training. â€Å"On-the-job training is training that takes place while employees are actually working. It means that skills can be gained while trainees are carrying out their jobs. This benefits both employees and the business. Employees learn in the real work environment and gain experience dealing with the tasks and challenges that they will meet during a normal working day. The business benefits by ensuring that the training is specific to the job. It also does not have to meet the additional costs of providing off-the-job training or losing working time†. (The Times 100, 2013) we can use the same training approach to apply it to our organisation, as we have to be careful about the cost. At the beginning we have to introduce them to the work place they are joining, an induction training should be provided to familiarize the new group joining to the company and colleagues, this orientation ensure their understanding to the company structure and the corporate culture and we can gain their involvement from day one to the organisation objectives and goals. We are examining here the instrumental learning type. On job training approach is applicable in this case study as it is considered cost effective and does not require an expert trainer to be hired from outside the company to teach them specific skills or to provide a certain knowledge. â€Å"OJT also spares the organisation the expense of taking employees out of the work environment for training and usually the cost of hiring outside trainer, because employees generally are capable of doing the training††. (Gomez-Mejia et al, 2012) At the same it can deliver a clear message about the company expectation while saving time, as senior skilled staff can train new employees divided in groups depending on job requirement and the group can actually learn the required skill while conducting day-to-day activities, it allow them to observe and try. One of benefits for the company will be having skilled employees that will need less supervision to perform tasks in the future, furthermore that will increase the loyalty to the employer and employees relationships, since they will be interacting closely with the senior staff for the training period. In addition they can get guidance and learn new technologies practically rather than theorist, where most of the times theories are not so clear to be applicable. â€Å"The guided on the-job training approach helps build relationships†. (Gomez-Mejia et al, 2012). The informal training or the OJT can enhance relationships between the workforce interacting together to acquire skills and learn better about our organisation, it can be also considered as socializing activity since they can be more open and communicate easily with no barrier, this process will make effective the on-boarding new employees. â€Å"Socialization is not a single event. Rather, socialisation is the iterative process between the new employee and the organisation as the individual develop skills, knowledge, role behaviour, and adjustment to norms and values in response to needs and expectations of organisation. (Jolton et al, 2010). For the employees it helps them to be more motivated and self confident about the job, where they can gain more skills in a practical way. They can get guidance and learn new technologies practically rather than theorist, where most of the times theories are not so clear to be applicable. We have to plan carefully the On-the-Job-Training, to allow immediate benefits and reduce the unproductive breaking-in period of the new joiners. If we leave them to learn through unplanned methods employees may feel anxious unmotivated as they are not confident about their job roles and performance. Since we are aiming for temporary manpower and flexible working patterns this method is considered efficient to make them productive as quickly as possible. In addition the OJT permit to examine at early stage employees basic skills problems, for this scenario we can plan for further training for a certain group, simply it can eliminate skills deficiency. According to Gomez-Mejia et al, 2012, â€Å"to survive and prosper in an increasingly heterogeneous society, organisations must capitalize on employee diversity as a source of competitive advantage†. Regardless that managing employee diversity is politically correct, diverse workforce enhance better problem solving, in our manufacturing company people tend to work in groups, interacting together can solve occurring problems easier as their life experience is dissimilar and they will approach the arising problems differently. Demographic and Cultural diversity can draw more flexibility to the company culture; sharing different experiences can make the work smoother and enjoyable, since learning is wider and more open. b. External advantages A team of different people sharing life experiences and values can improve our corporate culture to become a multicultural organisation having the experience to understand better international market, this advantage can aid the company to generate more profits and widen our market. Talented people are not limited to one culture, certain age or religion, our aim is to match the right people to the right job, so why to slim our choices since we can recruit from a pool of talents. By offering equal opportunity and overlooking differences we can focus better on having the right skills, Cultural diversity at the workplace can promote competitive advantage over rivals, Moreover respecting individual diversities in recruitment can increase productivity and promote the business image. Diversity at the workplace is the key to stay competitive and to be able to cope to the fast changing economy. â€Å"Given the global nature of business today, organisations have to create very specific and effective recruitment efforts to build a deep reservoir of global as well local talent to staff all their organisational levels. (Jolton et al, 2010) As example we can spot the light to Tesco operating in UK where people from different culture and background lives. â€Å"Tesco recognises that every person is different and will bring unique talents and experiences to a role†. (The Times 100, 2013). According to Tesco; â€Å"Difference can be our strength because talent and diversity are two sides of the same coin. To focus on one while ignoring the other is like trying to run a store with no customers – it just won’t work’†. (The Times 100, 2013). 3.2 Employee Diversity Challenges. However some challenges can draw, if diversity is not correctly managed in our organisation, as we can face negative outcomes in communication and productivity Resistance to change from majority and cultural clashes may occur, people tend not to accept each other easily especially if they consider minority inferior, or not as qualified to compete for a promotion or a career development. Cultural diversity may create a barrier between majority and minorities what can affect teamwork and participation. Communication flow might be distracted; people tend to be more involved in relationships with colleagues having the same culture and background, as they share same point of view and lifestyle, minorities can be left out of the company mainstream. Minorities will start to be unmotivated and not satisfied in the work environment and significant turnover and absenteeism can face the company. Diversity can enhance creativity, however minorities being ignored and less valued, will affect their enthusiasm and involvement in the company goals and achievement, and they won’t be able to perform efficiently and effectively due to the low morale. â€Å"Conversely, the proponents of relativity argue that failure to adapt HR practices to the needs of a diverse population may alienate much of the workforce and reduce their potential contributions†.
